Divorce in Virginia can be based on grounds of fault or "no-fault". A no-fault divorce can occur if there is a 12-month separation period, or a 6-month separation period, if no minor children and a marital separation agreement is signed. If the parties agree to divorce and the terms of the divorce, they can finalize the divorce in an uncontested matter.
